Topic: Bar discipline - Trust account violation - Miss.R.Disc. 13 - Reciprocal discipline - Disbarment

Summary of the Facts: The Mississippi Bar filed a formal complaint pursuant to Rule 13 of the Mississippi Rules of Discipline, requesting that the Court discipline David Hudgens.

Summary of Opinion Analysis: Hudgens self-reported a trust account violation to the Alabama State Bar. He knowingly misappropriated a client’s trust account funds and then misrepresented to the client that the funds were still available. He consented to disbarment in Alabama. Hudgens self-reported his Alabama disbarment to the Mississippi Bar. Hudgens is an active member in good standing with the Bar. Hudgens represents that his practice in Mississippi has been limited. While Hudgens is cooperative in this proceeding, he offers no reason or argument why the reciprocal discipline should not equal that of the Alabama Supreme Court. Therefore, David Hudgens shall be disbarred.
