Holding: On the Court's own motion, Rule 11 of the Mississippi Rules of Civil Procedure is amended as set forth in Exhibit "A' attached to the order.
Note: The Clerk of this Court shall spread this order upon the minutes of the Court and shall forthwith forward a true certified copy hereof to West Publishing Company for publication as soon as practical in the advance sheets of Southern Reporter, Second Series (Mississippi Edition) and in the next edition of Mississippi Rules of Court. Motion to Amend Mississippi Rules of Civil Procedure by Adopting a Rule Permitting Trial Courts to Order Physical and Mental Examinations is granted to the extent set forth herein. Rule 35 and the Comment thereto as set out in Exhibit "A" to this order are adopted. In the compilation of the Rules of Civil Procedure as they appear in the Mississippi Rules of Court, the new rule shall replace the reference to Rule 35 as "Omitted" and the existing comment. The Clerk of this Court shall spread this order upon the minutes of the Court and shall forthwith forward a true certified copy hereof to West Publishing Company for publication as soon as practical in the advance sheets of Southern Reporter, Second Series (Mississippi Edition) and in the next edition of Mississippi Rules of Court.
