Summary of the Facts: | Willie Doss was convicted of murder and sentenced to life imprisonment. He appeals. |
Summary of Opinion Analysis: | Doss argues that the verdict was against the overwhelming weight of the evidence, because he shot his wife in a moment of passion and the gun accidently fired when she pushed his arm. Not only did Doss admit firing the fatal shot, but there was testimony that his wife was in a posture to defend herself from injury when the shot was fired and that the shot was fired at least eighteen inches from her. This physical evidence refutes his argument that the shooting was accidental. |
