Topic: Post-conviction relief - Dismissal of charge - Successive petition

Summary of the Facts: Tommie Skinner pled guilty to one count of armed robbery and one count of second degree arson. He was sentenced to twenty years for armed robbery and ten years for arson, to run consecutively. He filed a petition for post-conviction relief which was denied. He appealed and the Supreme Court affirmed. Skinner filed a second motion for post-conviction relief which the court denied. He appeals.

Summary of Opinion Analysis: Skinner argues that the court erred in accepting his guilty plea to the arson charge, because there was an order dismissing the arson charge in justice court. However, the order from justice court was issued two days after Skinner entered a guilty plea. In addition, Skinner’s motion is barred as untimely and successive.
