Topic: Aggravated assault & Possession of firearm by felon - Weight of evidence

Summary of the Facts: Rick Griffin was convicted of aggravated assault and possession of a firearm by a convicted felon. He was sentenced to eighteen years for the aggravated assault and to three years for the possession of the firearm. He appeals.

Summary of Opinion Analysis: Griffin argues that the verdict was against the overwhelming weight of the evidence. The State presented three witnesses that testified that Griffin shot the gun at least three times. Further, the victim’s sister and brother-in-law testified that they observed Griffin shoot the gun at the victim. Therefore, the jury was justified in finding Griffin guilty.
