Topic: Aggravated assault - Weight of evidence

Summary of the Facts: Aires Chambliss was convicted of causing serious bodily injury to Demetrius Miller by throwing a foreign substance on Miller which resulted in second degree burns. He was sentenced to ten years. He appeals.

Summary of Opinion Analysis: Chambliss argues that the verdict of the jury was against the overwhelming weight of the evidence. In light of the evidence presented at trial, and giving the benefit of favorable inferences to the State, the verdict is not contrary to the overwhelming weight of the evidence. Two witnesses testified that it was Chambliss who threw the substance on them. Furthermore, Chambliss, testifying on his own behalf, admitted to throwing the substance on Miller. It was also established that Miller suffered serious injury to his right side. The question of Chambliss’ intent and knowledge is a question for the jury. There was ample evidence on which the jury could properly determine that Chambliss did intend to hurt Miller.
