Topic: Child fondling - Weight of evidence

Summary of the Facts: Johnny Boykin was convicted of two counts of child fondling. He appeals.

Summary of Opinion Analysis: Boykin challenges the weight of the evidence. His argument is primarily based on alleged discrepancies between the statements the two victims gave the deputy and the testimony the girls gave at trial. The jury was faced with the victims’ account of the crime versus the defendant’s denial of the crime. Since the jury’s verdict was supported by the evidence, Boykin’s weight of the evidence issue must fail.
