Disposition: application for regular(1) disability retirement was denied by the Public Employees Retirement System's Medical Board. Disability Appeals Committee recommended that Shurden's application for permanent disability be denied, and the PERS Board of Trustees approved and adopted this recommendation. The Circuit Court of First Judicial District of Hinds County, which reversed the denial of benefits, finding that the Board's decision was arbitrary and capricious and not supported by the evidence contained in the record.
