Date of Trial Judgment: 08-28-1997 Appealed from: MADISON COUNTY CIRCUIT COURT Judge: John Toney Disposition: After the City failed to act on Bryan's request for a building permit, Bryan appealed, by bill of exceptions, to the Madison County Circuit Court which initially ordered the City to approve Bryan's plan. However, the circuit court reversed its position and held the issue to be moot. Afterwards, the circuit court, applying Rule 11, awarded costs and attorney's fees to Bryan. |
