Topic: | Post-conviction relief - Successive writ - Evidentiary hearing |
Summary of the Facts: | Following an indictment for possession of cocaine, the circuit court revoked James Lyons’ probation. Lyons filed a motion for post-conviction relief which the court denied. He then filed a second motion styled as a motion for habeas corpus relief. The circuit court treated the habeas petition as a motion for post-conviction relief and summarily denied it as a successive writ. Lyons appeals. |
