Topic: Post-conviction relief - Excessive sentence

Summary of the Facts: Julius Holmes, Jr. pled guilty to statutory rape and was sentenced to twenty years. He filed a motion for post-conviction relief seeking the circuit court to lessen his twenty year sentence. The court dismissed the motion, and Holmes appeals.

Summary of Opinion Analysis: Holmes argues that the court erred in failing to reduce his sentence to a level that is representative of the rehabilitative goals of the justice system. For pleading guilty to statutory rape, Holmes could have been sentenced to life in prison. The circuit court imposed a lesser sentence of twenty years, which is the minimum allowable under the statute. The sentence is appropriate.
