Summary of the Facts: Willie Southern filed a complaint against the City of Jackson and Officer Gerald Jones. The City of Jackson filed a motion to dismiss for want of jurisdiction. The court dismissed the case, and Southern appeals.

Summary of Opinion Analysis: Section 11-46-11 (3) provides that all actions brought under the Tort Claims Act shall be commenced within one year next after the date of the tortious, wrongful or otherwise actionable conduct on which the liability phase of the action is based. The events described in the complaint are alleged to have occurred on March 28, 1999, and Southern's complaint was not filed until October 18, 2001, well after the one year statutory limit.
