Topic: Post-conviction relief - Successive writ

Summary of the Facts: Alaric Black pled guilty to the sale of a controlled substance within 1500 feet of a school. He was sentenced to twenty years. He filed a motion for post-conviction relief which was denied. Black filed a second motion for post-conviction relief which was also denied. Black filed a motion for rehearing on the denial of his second post-conviction relief motion which was denied. He appeals.

Summary of Opinion Analysis: Black’s claims were his third request for post-conviction relief. Because he has not provided any evidence or facts that would satisfy any of the exceptions to the successive writ bar, his request for post-conviction relief is procedurally barred as a successive writ.
