Topic: Unemployment benefits - Misconduct

Summary of the Facts: Magnolia Regional Health Center terminated the employment of Andreda Brown for misconduct. Brown filed for unemployment benefits which were denied by the Mississippi Employment Security Commission. She appealed her denial of benefits to both an appeals referee and the circuit court, both of which affirmed the denial. Brown appeals.

Summary of Opinion Analysis: Misconduct is conduct evincing such willful and wanton disregard of the employer's interest as is found in deliberate violations or disregard of standards of behavior which the employer has the right to expect from his employee. Brown refused to release a computer password that was essential to the daily functions of Magnolia Regional, even when she was ordered to do so by the chief executive officer of Magnolia Regional. Magnolia Regional had an expectation that Brown would divulge the password so that its daily operations could be carried out. Refusing the orders demonstrates a willful and wanton disregard of that expectation.
