Topic: Post-conviction relief - Sufficiency of evidence

Summary of the Facts: Mark Jackson, a Mississippi Department of Corrections inmate, filed suit alleging that prison officials erred in finding him guilty of a Rule Violation Report for engaging in a sexual act with others or indecent exposure, and reclassifying Jackson as a sexual predator within the prison classification system. After exhausting appellate procedures afforded to prisoners under the Administrative Remedy Program, Jackson filed a petition to show cause in the circuit court. The court affirmed the decision of the ARP and dismissed Jackson’s petition. Jackson appeals.

Summary of Opinion Analysis: Jackson failed to include a copy of the issued RVR containing the facts that he asserts as error. Without a copy of the actual RVR including the board’s findings, the lower court and the appellate court are presented with insufficient evidence to overturn the board’s finding of guilt.
