Topic: Post-conviction relief - Ineffective assistance of counsel

Summary of the Facts: In 1981, Ray Chaney pled guilty to five counts of burglary of a dwelling. He filed a motion for post-conviction relief over thirty years later. The court dismissed his motion, and Chaney appeals.

Summary of Opinion Analysis: Chaney argues his attorney was ineffective. Chaney presented an unsworn statement as his only piece of evidence in support of his argument. Since he makes bare assertions in support of his ineffective-assistance-of-counsel claims, he has not shown that his counsel’s performance was deficient.
