Holding: On the Court's own motion, the Newton County Circuit Court's Judgment Granting Motion for Directed Verdict and Dismissing Petition for Post-Conviction Relief is vacated. This case is remanded to the Circuit Court of Newton County for a full evidentiary hearing and ruling on the following issues: (1) mental retardation; (2) ineffective assistance of counsel on the issue of mental illness and (3) ineffective assistance of counsel on the issue of competency. Goodin v. State, 856 So. 2d 267, 284-85 (Miss. 2003).
