Topic: | Aggravated assault - Sufficiency of evidence |
Summary of the Facts: | Curtis Hoye was convicted of aggravated assault and was sentenced to ten years. He appeals. |
Summary of Opinion Analysis: | Hoye argues that the evidence was insufficient to support the conviction. However, numerous witnesses testified that Hoye retrieved a metal object from his car, that he attacked the victim with this weapon, that the victim was unarmed and did not attempt to fight back, and that two onlookers each attempted to stop Hoye. This was sufficient evidence to support the conviction. |
