Topic: Post-conviction relief - Factual basis for plea - Ineffective assistance of counsel

Summary of the Facts: Carlos Jackson pled guilty to murder and aggravated assault. He was sentenced to life imprisonment for murder and twenty years for aggravated assault. Jackson filed a petition for post-conviction relief which was denied. He appeals.

Summary of Opinion Analysis: Issue 1: Factual basis for plea Jackson argues that there was no factual basis supporting his guilty plea for murder and for aggravated assault. Intent can be inferred through Jackson’s actions. He came to the apartment carrying a gun and shot at the victims. A jury would have been able to infer this intent. There was a factual basis for the judge, within his discretion, to accept the guilty plea. Issue 2: Ineffective assistance of counsel Jackson argues that he was denied effective assistance of counsel. However, Jackson's guilty plea, statements he made during the plea hearing, and his attorney's signed certificate demonstrated that there was effective assistance.
